This Privacy Policy describes how Tukai Travels Limited ("we," "us," or "Tukai"), process personal information in relation to your use of websites, applications, and other offerings from Tukai (collectively, the "Tukai Services"). We may change or otherwise modify this Agreement in the future and will notify you of material changes by either sending a notice to the email address associated with your profile or by placing a notice on our platforms.

We will note the date that revisions were last made at the top of this Policy, and any revisions will take effect upon posting.

WHO CONTROLS MY PERSONAL INFORMATION

Tukai is responsible for your information under this Privacy Policy (the "Controller").

This Privacy Policy also applies to the Payment Services provided to you by Tukai. When using the Payment Services, you will also be providing your personal information to one or more Tukai Payments entities (the "Payments Controller"), which will be responsible for your information related to the Payment Services.

PERSONAL INFORMATION WE COLLECT

We collect personal information about you when you use Tukai. Without it, we may not be able to provide all services requested. This information includes:

Contact, Account, and Profile Information

Such as your first name, last name, phone number, address, email address, date of birth, and profile photo, some of which will depend on the features you use.

Identity Information

Where appropriate, we may ask you for an image of your government-issued ID document(s), passport, national ID card, tax ID, or driving license (in accordance with applicable laws) or other verification information, such as your date of birth, address, email address, phone number, or digital identity, and/or a selfie when we verify your ID. If a copy of your ID is provided to us, we will obtain information from your ID.

Payment Transaction Information

Such as payment account, credit card information, bank account information, payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, and other related transaction details.

INFORMATION YOU CHOOSE TO GIVE US

You can choose to provide us with additional personal information, including:

Additional Profile Information

Such as gender, preferred language(s), city, personal description, and any additional profile information you provide.

Information About Others

Such as a payment instrument or contact information belonging to another person or information about another person related to the booking. By providing us with personal information about others, you certify that you have authorization to provide that information to Tukai for the purposes described in this Privacy Policy and you have shared the Tukai Privacy Policy with the owner of said information.

Biometric Information

Such as facial recognition data derived from photos, access verification prompts and identification documents you submit for verification, where offered and with your consent where required by applicable law.

Communications Information

Such as email, call, message, SMS, and text information where delivery is enabled on or through the Tukai Services.

User-Generated Content

Such as any photos, videos, and other content you choose to provide.

Support Information

Such as call recordings and transcripts consistent with the requirements under applicable law, chat information, and messages collected to provide customer support services, including investigating and responding to user concerns and monitoring and improving our support processes.

Other Information

Such as when you fill in a form, add information to your account, respond to surveys, participate in research, post to community forums, participate in promotions, import or manually enter address book contacts, provide your address and/or geolocation, provide business information, or share your experience with us. This may include health information if you choose to share it with us.

INFORMATION AUTOMATICALLY COLLECTED BY USING TUKAI AND OUR PAYMENT SERVICES

When you use Tukai and Payment Services, we automatically collect certain information. This information may include:

Geolocation Information

Such as precise or approximate location determined from your IP address, mobile or other device's GPS, or other information you share with us, depending on your device settings. We may also collect this information when you're not using the app if you enable this through your settings or device permissions.

Usage Information

Such as searches for Listings, bookings you have made, additional services you have added, access dates and times, the pages you've viewed or engaged with before or after using Tukai, and other actions on the Platform, including the pages or content you view and links you click to third-party applications. We may collect this information even if you haven't created a Tukai account or logged in.

Device Information

Such as IP address, hardware and software information, device information, device event information, unique identifiers, crash data, and read receipts. We may collect this information even if you haven't created a Tukai account or logged in.

Cookies and Similar Technologies

We may collect personal information from other sources, such as:

Third-Party Applications

If you choose to link, connect, or login to Tukai with a third-party service, such as Google and Facebook, you direct the service to send us information such as your registration, friends list, and profile information as controlled by that service or as authorized by you via your privacy settings at that service.

Complainants

If an Experience Organizer, Community Admin, User, or any third party submits a complaint about you, we may receive information relating to the specific complaint made in order to understand and, where relevant, address the complaint.

INFORMATION SECURITY

We have implemented appropriate administrative, technical, and physical security procedures to help protect your information. We only authorize specific personnel to access personal information, and they may do so only for permitted business functions. We use encryption when transmitting your information between your system and ours, and between our system and those of the parties with whom we share information. We also employ firewalls and intrusion detection systems to help prevent unauthorized access to your information. However, we cannot guarantee the security of information from unauthorized entry or use, hardware or software failure, or other circumstances outside of our control.

INFORMATION DELETION AND RETENTION

We will retain copies of your information for as long as you maintain your account or as necessary in connection with the purposes set out in this Policy, unless applicable law requires a longer retention period. In addition, we may retain your information for the duration of any period necessary to establish, exercise, or defend any legal rights.

These Terms of Service ("Terms") are a binding legal agreement between you and Tukai Travels Limited ("Tukai") that govern your use of the websites, applications, and other offerings from Tukai (collectively, the "Tukai Services"). When used in these Terms, "Tukai," "company" "we," "us," or "our" refers to Tukai Travels Limited, the entity with whom you are contracting.

The Services are provided by Tukai Travels Limited, a Kenyan incorporated limited liability company located in the Republic of Kenya with its registered office at Parkwood Villas.

These Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity and Tukai concerning your access and use of the Services. You agree that by accessing the services, you have read, understood and agreed to be bound by all these legal terms. IF YOU DISAGREE, DISCONTINUE USE IMMEDIATELY.

If you are a consumer in the EU or UK you have a legal right to withdraw from this Agreement within 14 days of the Agreement being made. You can do this, or terminate this Agreement at any other time, by closing your account by accessing your profile whilst logged in and selecting the "delete account" option) and no longer accessing or using the Services.

If you are a consumer in the EU or UK you will have certain mandatory consumer rights. If you are a consumer living elsewhere, you may also have consumer rights under the laws of your territory. Nothing in this Agreement affects your mandatory consumer rights.

Any information, text, links, graphics, photos, audio, videos, data, code or other materials or arrangements of materials that you can view on, access or otherwise interact with through the Services shall be referred to as "Content."

We may change or otherwise modify this Agreement in the future in accordance with the terms and conditions herein, and you understand and agree that your continued access or use of the Services after such change signifies your acceptance of the updated or modified Agreement. We will note the date that revisions were last made to this Agreement at the top of this Agreement, and any revisions will take effect upon posting. We will notify you of material changes to these terms and conditions by either sending a notice to the email address associated with your profile or by placing a notice on our platforms. If you don't want to accept any changes to this Agreement, you may close your account and cease to access the Services.

USE OF THE SERVICES

As a condition of your use of the Services, you agree that (i) all information supplied by you via the Services to Tukai is true, accurate, current and complete, (ii) you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you, (iii) you are 13 years of age or older. Tukai does not knowingly collect the information of anyone under the age of 13. The Services are intended for users at least 13yrs of age. All users who are minors in their jurisdiction must have the permission of and be directly supervised by their parent or guardian to use the services, who must read and agree to these terms on behalf of the minor.

If you are a consumer resident in the EU or the UK, we may deny you access to the Services if you violate this Agreement, or for any other reasonable cause. If you are not a consumer resident in the EU or the UK, we retain the right at our sole discretion to deny you access to the Services, at any time and for any reason, including, but not limited to, for violation of this Agreement. By using the Services, including any products or services that facilitate the sharing of Content to or from third party sites, you understand that you are solely responsible for any information that you share with Tukai. You may access the Services solely as intended through the provided functionality of the Services and as permitted under this Agreement.

To access certain features of the Services, you will need to create an account. When you create an account, you must provide complete and accurate information. You are solely responsible for the activity that occurs on your account, including your interaction and communication with others, and you must safeguard your account. Towards this end, you agree to keep your contact information up to date.

If you are creating a Tukai account for commercial purposes and are accepting this Agreement on behalf of a company, organisation or other legal entity, you agree that you are authorised to do so and have the authority to bind such entity to this Agreement, in which case the words "you" and "your" as used in this Agreement shall refer to such entity and the individual acting on behalf of the company shall be referred to as a "Business Representative".

Tukai offers you the ability to search for, select, and book events, locations and experiences with third-party suppliers with or without leaving the platform.

IMPORTANT: Tukai does not itself sell experiences; it allows third parties to sell their experiences on Tukai.

Through your use of the Services, you may encounter links to third party sites and apps or be able to interact with third party sites and apps. This may include the ability to book experiences, locations or events and share Content from the Services, including your Content, with such third-party sites and apps. Please be aware that third party sites and apps may publicly display such shared Content. Such third parties may charge a fee for booking by way of their websites. Therefore, you should make whatever investigation you feel is necessary or appropriate before proceeding with any transaction with any third party to determine whether a charge will be incurred. Where Tukai provides details of fees or charges for such third-party content or services, such information is provided for convenience and information purposes only and accuracy must be verified by yourself. Any interactions with third party sites and apps are at your own risk. You expressly acknowledge and agree that Tukai is in no way responsible or liable for any such third-party sites or apps.

FEES

Tukai will charge subscription fees (and applicable Taxes) to Users and Experience Organizers for the right to use the Services at regular intervals and service fees on experiences. Your subscriptions will continue and automatically renew unless cancelled. You consent to charging your payment method in a recurring manner without your prior approval on each recurring charge until cancellation. Any applicable service fees are disclosed to users before making a booking on an experience. Except as otherwise provided on the Services, service and subscription fees are non-refundable. Tukai reserves the right to change the fees at any time and will provide users notice of any fee changes before they become effective. Fee changes will not affect bookings made prior to the effective date of the fee change. If you disagree with a fee change you may terminate this agreement at any time.

EXPERIENCES

Users can search for Experiences using criteria like the type of experience, location, and dates. Search results are based on their relevance to the search and other criteria. Relevance considers factors like price, availability, reviews, customer service and cancellation history, popularity, previous experiences and saved items, organizer requirements and more.

When you book an experience, you are agreeing to pay all charges for your booking including the experience price, applicable fees like service fee, offline fees, taxes, and any other items identified during checkout (collectively, "Total Price"). If you choose to pay using a currency that differs from the currency set by the Organizer for their Experience, the price displayed to you is based on a currency conversion rate determined by us.

When you receive the booking confirmation, a contract is formed directly between you and the Organizer. By making a booking you are agreeing to the terms of the contract. The terms of the contract include these Terms, all terms of the booking, including without limitation, the cancellation policy and any other rules, standards, policies, or requirements identified in the Experience or during checkout that apply to the booking. It is your responsibility to read and understand these terms of the contract including these Terms and all terms of the booking including all rules, standards, policies, and requirements prior to booking an Experience.

You are responsible for confirming that you, and anyone you invite, meet minimum age, proficiency, fitness, or other requirements. You are responsible for informing the Organizer of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend, or use the Experience. Except where expressly authorized, you may not allow any person to join an Experience unless they are included as an additional person during the booking process.

CANCELLATIONS, REFUNDS AND BOOKING MODIFICATIONS

In general, if you cancel a booking, the amount refunded to you is determined by the Organizer's cancellation policy that applies to that booking.

Where the payment was received directly by Tukai on behalf of the Organizer, the refund will be issued in 5 business days.

Booking modifications are based on the Organizer's terms on modification, detailed under the Experience.

COMMUNITIES

Users may join Communities created by other users on the Services to bring together users with common interests.

Communities are controlled and managed by their creators directly.

The provisions under Use of Services, Use of Interactive Areas and Prohibited Activities apply to Communities.

COPYRIGHT NOTIFICATIONS

Tukai has created various profiles of restaurants, attractions, destinations and other locations for the discovery of users. Various visual media used have been pulled from internet platforms and are not owned by Tukai.

PRODUCTS

Tukai may, from time to time, decide to change, update or discontinue certain products and features of the Services. You agree and understand that Tukai has no obligation to store or maintain your Content or other information you provide, except to the extent required by applicable law. Nothing in this Agreement affects your mandatory consumer rights.

PROHIBITED ACTIVITIES

(i) use of the Services or Content for any commercial purpose, outside the scope of those commercial purposes explicitly permitted under this Agreement and related guidelines as made available by Tukai;

(ii) access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy or otherwise exploit any Content of the Services, including but not limited to, user profiles and photos, using any robot, spider, scraper or other automated means or any manual process for any purpose not in accordance with this Agreement or without our express written permission;

(iii) violate the restrictions in any robot exclusion headers on the Services or bypass or circumvent other measures employed to prevent or limit access to the Services;

(iv) take any action that imposes, or may impose, in our sole discretion (or, if you are a consumer resident in the UK or EU, in our reasonable discretion), an unreasonable or disproportionately large load on our infrastructure;

(v) deep-link to any portion of the Services for any purpose without our express written permission;

(vi) "frame", "mirror" or otherwise incorporate any part of the Services into any other websites or service without our prior written authorisation

(vii) attempt to modify, translate, adapt, edit, decompile, disassemble or reverse engineer any software programs used by Tukai in connection with the Services;

(viii) circumvent, disable or otherwise interfere with security-related features of the Services or features that prevent or restrict use or copying of any Content;

(ix) download any Content unless it's expressly made available for download by Tukai; or

(x) use, or assist, encourage, or enable any third-party to use, any robot, spider, artificial intelligence (AI) system, or other automated device, process or means to access, retrieve, copy, scrape, aggregate, collect, download, or otherwise index any portion of the Services or any Content, except as expressly permitted by Tukai in writing.

PRIVACY POLICY AND DISCLOSURES

Any personal information you post on or otherwise submit in connection with the Services will be used in accordance with our Privacy Policy.

REVIEWS, COMMENTS AND USE OF OTHER INTERACTIVE AREAS; LICENCE GRANT

We appreciate hearing from you. Please be aware that by providing your Content to or through the Services, be it via email, posting via any Tukai synchronisation product, via the Services and applications of others, or otherwise, including any of your Content that is transmitted to your Tukai account by virtue of any Tukai product or service, reviews, questions, photographs or videos, comments, suggestions, ideas or the like contained in any of your Content, you grant Tukai a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sublicensable right to (a) host, use, reproduce, modify, run, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Content of yours throughout the world in any media, now known or hereafter devised; (b) make your Content available to the rest of the world and to let others do the same; (c) to provide, promote, and improve the Services and to make your Content shared on the Services available to other companies, organisations or individuals for the syndication, broadcast, distribution, promotion or publication of such Content of yours on other media and services, subject to our Privacy Policy and this Agreement; and (d) use the name and/or trademark that you submit in connection with such Content of yours. You acknowledge that Tukai may choose to provide attribution of your Content at our sole discretion (or, if you are a consumer resident in the UK or EU, in our reasonable discretion). You further grant Tukai the right to pursue at law any person or entity that violates your or Tukai's rights in your Content by a breach of this Agreement. You acknowledge and agree that your Content is non-confidential and non-proprietary. You agree that you own or have the necessary licences, rights (including copyright and other proprietary rights), consents and permissions to publish and otherwise use (and for Tukai to publish and otherwise use) your Content as authorised under this Agreement.

If it is determined that you retain moral rights (including rights of attribution or integrity) in your Content, you hereby declare that, to the extent permitted by applicable law, (a) you do not require that any personally identifying information be used in connection with the Content, or any derivative works of or upgrades or updates thereto; (b) you have no objection to the publication, use, modification, deletion and exploitation of your Content by Tukai or their licensees, successors and assigns; (c) you forever waive and agree not to claim or assert any entitlement to any and all moral rights of an author in any of your Content; and (d) you forever release Tukai and their licensees, successors and assigns, from any claims that you could otherwise assert against Tukai by virtue of any such moral rights.

Note that any feedback and other suggestions you provide may be used at any time and we are under no obligation to keep them confidential.

The Services may contain discussion forums, communities, bulletin boards, review services, travel feeds or other forums in which you may post your Content, such as reviews of experiences, messages, materials or other items ("Interactive Areas"). If Tukai provides such Interactive Areas on the platforms, you are solely responsible for your use of such Interactive Areas and use them at your own risk. Tukai does not guarantee any confidentiality with respect to any of your Content you provide to the Services or in any Interactive Area.

To the extent that Tukai provides any form of private communication channel between users, you agree that Tukai may monitor the substance of such communications to help safeguard our community and the Services. You understand that Tukai does not edit or control the user messages posted to or distributed through the Services, including through any chat rooms, bulletin boards, communities or other communications forums, and will not be in any way responsible or liable for such messaging. In particular, Tukai does not edit or control users' Content that appears on the platform. Tukai nevertheless reserves the right to remove and/or restrict without notice any such messaging or other Content from the Services, where they believe in good faith that such Content breaches this Agreement or otherwise believe the removal and/or restriction is reasonably necessary to safeguard the rights of Tukai and/or other users of the Services.

Should you disagree with the removal of your Content from the Services, you can appeal our decision through emailing us at admin@tukai.co By using any Interactive Areas, you expressly agree only to submit Content of yours that complies with Tukai's published guidelines, as are in force at the time of submission and made available to you by Tukai. You expressly agree not to post, upload to, transmit, distribute, store, create or otherwise publish through the Services any Content of yours that:

Is false, unlawful, misleading, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing (or advocates harassment of another person), threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable;

Is patently offensive to the online community, such as that which promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;

Would constitute, encourage, promote or provide instructions for conduct of an illegal activity, a criminal offense, give rise to civil liability, violate the rights of any party in any country of the world, or that would otherwise create liability or violate any local, national or international law,

Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy or providing or creating computer viruses;

May infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party. Content that promotes an illegal or unauthorised copy of another's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files;

Constitutes mass mailings or "spamming", "junk mail", "chain letters" or "pyramid schemes";

Impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity, including Tukai;

Is private information of any third party, including, without limitation, addresses, phone numbers, email addresses, identification numbers and credit card numbers.

Contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);

Include or are intended to facilitate viruses, corrupted data or other harmful, disruptive or destructive files;

Is unrelated to the topic of the Interactive Area(s) in which such Content is posted; or

In the sole judgment of Tukai (or, if you are a consumer resident in the UK or EU, in our reasonable judgment), (a) violates the previous subsections herein, (b) violates Tukai's related guidelines as made available to you by Tukai, (c) is objectionable, (d) restricts or inhibits any other person from using or enjoying the Interactive Areas or any other aspect of the Services, or (e) may expose Tukai or their users to any harm or liability of any type.

To the extent permitted by applicable law, Tukai takes no responsibility and assume no liability for any Content posted, stored, transmitted or uploaded to the Services by you (in the case of your Content) or any third party (in the case of any and all Content more generally), or for any loss or damage thereto, nor is Tukai liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. As a provider of interactive services, and to the extent permitted by applicable law, Tukai is not liable for any statements, representations or any other Content provided by its users (including you as to your Content) in the websites or any other forum. Although Tukai has no obligation to screen, edit or monitor any of the Content posted to or distributed through any Interactive Area, Tukai reserves the right, and has absolute discretion (or, if you are a consumer resident in the UK or EU, in our reasonable discretion), to remove, screen, translate or edit without notice any Content posted or stored on the Services at any time and for any reason, or to have such actions performed by third parties on their behalf. To the extent permitted by applicable law, you are solely responsible for creating backup copies of and replacing any Content you post or otherwise submit to us or store on the Services at your sole cost and expense.

RESTRICTION AND/OR SUSPENSION OF YOUR USE OF THE SERVICES

Any use of the Interactive Areas or other aspects of the Services in violation of the foregoing violates the terms of this Agreement and may result in among other things, termination or suspension of your rights to use the Interactive Areas and/or the Services more generally. Tukai may also suspend the processing of notices and complaints submitted through the Services if you frequently submit manifestly unfounded notices or complaints.

Restricted License Option

In restricting Tukai's Licence Rights, you may elect on a going forward basis to limit Tukai's use of your Content under this Agreement by opting to provide Tukai with a more limited license (such limited licence to be referred to herein as a "Restricted Licence"). You may make this election by contacting Tukai through their email admin@tukai.co If you make this election, the rights you grant Tukai to your Content pursuant to the licence terms set forth above (referred to as the "Standard Licence") shall be limited such that Tukai shall not hold a Standard Licence to any of your Content other than the text-based reviews and ratings you post (as to which Tukai shall continue to be granted a Standard Licence), but shall be granted a "Restricted Licence" as to the balance of your Content.

LIABILITY DISCLAIMER

PLEASE READ THIS SECTION CAREFULLY. THIS SECTION LIMITS TUKAI'S LIABILITY TO YOU FOR ISSUES THAT MAY ARISE IN CONNECTION WITH YOUR USE OF THE SERVICES.

THE INFORMATION, SOFTWARE, PRODUCTS AND SERVICES PUBLISHED ON OR OTHERWISE PROVIDED VIA THE SERVICES (INCLUDING, WITHOUT LIMITATION, THOSE CREATED OR POWERED BY AI) MAY INCLUDE INACCURACIES OR ERRORS, INCLUDING EXPERIENCE AVAILABILITY AND PRICING ERRORS. TUKAI DOES NOT GUARANTEE THE ACCURACY OF, AND DISCLAIMS ALL LIABILITY FOR, ANY OBVIOUS ERRORS OR OTHER INACCURACIES RELATING TO THE INFORMATION AND DESCRIPTION OF THE EXPERIENCES, RESTAURANTS OR ANY OTHER ACTIVITY DISPLAYED ON THE PLATFORM (INCLUDING, WITHOUT LIMITATION, THE PRICING, AVAILABILITY, PHOTOGRAPHS, EXPERIENCE, RESTAURANT OR OTHER ACTIVITY, GENERAL PRODUCT DESCRIPTIONS, REVIEWS AND RATINGS, ETC.). IN ADDITION, TUKAI EXPRESSLY RESERVE THE RIGHT TO CORRECT ANY AVAILABILITY AND OBVIOUS PRICING ERRORS ON THE SERVICES AND/OR ON PENDING EXPERIENCES MADE UNDER AN OBVIOUSLY INCORRECT PRICE.

If Tukai is found liable for any loss or damage that arises out of or is in any way connected with your use of the Services, then its liability will in no event exceed, in the aggregate, the greater of (a) the transaction fees paid to the Tukai for the transaction(s) on or through the Services giving rise to the claim, or (b) One-Hundred Dollars (US $100.00).

The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose.

THIS AGREEMENT AND THE FOREGOING LIABILITY DISCLAIMER DO NOT AFFECT MANDATORY LEGAL RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, FOR EXAMPLE UNDER CONSUMER PROTECTION LAWS IN PLACE IN CERTAIN COUNTRIES.

JURISDICTION AND GOVERNING LAW

This Agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of Kenya. You hereby consent to the exclusive jurisdiction and venue of courts in Kenya and stipulate to the fairness and convenience of proceedings in such courts for all disputes, both contractual and non-contractual, arising out of or relating to the use of the Services by you or any third party.

Use of the Services is unauthorised in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph. Nothing in this clause shall limit the right of Tukai to take proceedings against you in any other court, or courts, of competent jurisdiction. The foregoing shall not apply to the extent that applicable law in your country of residence requires application of another law and/or jurisdiction -- in particular, if you are using the Services as a consumer -- and this cannot be excluded by contract and will not be governed by the United Nations Conventions on Contracts for the International Sale of Goods, if otherwise applicable. If you use the Services as a consumer, and not as a business or Business Representative, you may be entitled to bring claims against Tukai in the Courts of your country of residence. This clause shall otherwise apply to the maximum extent allowed in your country or residence.

CLASS ACTIONS AND REPRESENTATIVE PROCEEDINGS

You acknowledge and agree that, to the fullest extent permitted by law to waive the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceedings.

Other supplemental policies and terms linked to these Terms apply to your use of Tukai Services and are incorporated by reference, and form part of your agreement with Tukai.

Some areas of the Tukai Services implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service

If you access or download our application from the Apple App Store, you agree to Apple's Licensed Application End User License Agreement.
